YOUR GARDEN DECKING MAY REQUIRE PLANNING PERMISSION!
Installing decking, or other raised platforms, in your garden is typically undertaken within the parameters of permitted development.
However, since 2008, for this to be the case your decking must be:
i. No more than 30cm above the ground.
ii. Together with other extensions, outbuildings etc, the decking or platforms should cover no more than 50 per cent of the garden area.
The permitted development allowances described here apply to houses rather than flats, maisonettes or other buildings. Prior to 2008 different rules applied which I’m not going to delve into here as in any event, if your decking has been in place for that long it will presumably be immune from enforcement action. As always, consult your solicitor for more info as my notes are for general guidance only.
